Introduction and Acceptance of Terms
1.1 Agreement: These Terms and Conditions (the “Terms”) govern your use of the Soletroll website (the “Site”) and your purchase of any products or services (collectively, the “Services”) from Soletroll.
1.2 Acceptance: By accessing or using the Site or purchasing products/Services, you agree to be bound by these Terms. If you do not agree to all the Terms, you must not use the Site or Services.
1.3 Legal Age: You affirm that you are 18 years of age or older, or have legal parental or guardian consent, and are fully able and competent to enter into these Terms.
Product and Pricing Information
2.1 Product Descriptions: We strive to be as accurate as possible in describing products, including card conditions, sets, and grading. However, we do not warrant that product descriptions or other content are entirely accurate, complete, reliable, current, or error-free.
2.2 Card Condition/Grading:
- Ungraded Cards: Condition standards (e.g., Near Mint, Lightly Played) are based on Soletroll’s professional assessment. These are subjective and not guaranteed to match third-party grading standards.
- Graded Cards: Cards sold with a third-party grade (e.g., PSA, BGS, CGC) are sold based on the grade assigned by that grading company. Soletroll is not responsible for the accuracy of the third-party grade or the slab/case condition, except as specified in Section 4.
2.3 Pricing: All prices are subject to change without notice. We reserve the right to correct any errors in pricing or descriptions. In the event of a pricing error, we reserve the right to refuse or cancel any orders placed at the incorrect price.
2.4 Taxes: Prices do not include any applicable local, state, or federal taxes, which will be added to your total purchase price.
Order Processing and Payment
3.1 Order Acceptance: The receipt of an order confirmation does not constitute our acceptance of an order or our confirmation of an offer to sell. We reserve the right to refuse or cancel any order for any reason, including limitations on quantities available for purchase, inaccuracies, or errors in product or pricing information.
3.2 Payment: Payment must be received by Soletroll prior to acceptance of an order. We accept [List Accepted Payment Methods, Cash on pick up, Credit cards, Third party payment gateways]
3.3 Pre-Orders: Payment for pre-order items is charged immediately upon order. Release dates are subject to change by the manufacturer. We will notify you of significant changes, but we are not responsible for manufacturer delays.
Shipping, Risk of Loss, and Returns
4.1 Shipping: We ship to addresses in All island Democratic republic of Sri Lanka and its territories. Shipping costs and methods are outlined in our separate Shipping Policy.
4.2 Risk of Loss: The risk of loss and title for items purchased from Soletroll passes to you upon our delivery to the carrier (i.e., when the package is picked up by the shipping service).
4.3 Returns/Refunds:
- Due to the volatile market value and nature of trading cards, all sales are generally considered final.
- Exceptions: Returns are only accepted if the item is demonstrably not as described, or if the wrong item was shipped.
- Sealed Product: Sealed products (booster boxes, packs, etc.) must be returned unopened and undamaged. Once opened, they are non-returnable.
- Process: Any request for return must be initiated within 2 days of delivery and must follow the procedure outlined in our separate Refund and Return Policy.
- Authentication: Cards being returned may be subject to authentication upon return before a refund is issued.
Intellectual Property
5.1 Ownership: All content on the Site, including text, graphics, logos, images, and software, is the property of Soletroll or its content suppliers and is protected by copyright and intellectual property laws.
5.2 License: You are granted a limited, non-exclusive, non-transferable license to access and make personal use of the Site and not to download (other than page caching) or modify it without express written consent from Soletroll.
Limitation of Liability and Indemnification
6.1 Limitation of Liability: Soletroll, its officers, directors, employees, or agents, will not be liable for any indirect, incidental, punitive, or consequential damages arising from your use of the Site or any products purchased.
6.2 Maximum Liability: In no event shall our total liability to you for all damages, losses, and causes of action exceed the total amount paid by you for the specific product that is the subject of the claim.
6.3 Indemnification: You agree to indemnify, defend, and hold harmless Soletroll from and against any claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site or your breach of these Terms.
Governing Law and Dispute Resolution
7.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of [Colombo and Sri Lanka] without regard to its conflict of law principles.
7.2 Dispute Resolution: Any dispute or claim relating in any way to your use of the Site or to any products sold or distributed by Soletroll will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. Miscellaneous Provisions
8.1 Changes to Terms: We reserve the right to make changes to our Site, policies, and these Terms at any time. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms.
8.2 Severability: If any of these Terms shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
